Booking Terms

TalentApp Booking Terms and Conditions. This is a constantly updated document and could change periodically. It is your responsibility to check the latest version and read accordingly. You can see the latest edit date at the bottom of the page.

1. Bookings

The making of a booking does not constitute the creation of a contract and TalentApp Limited reserves the right to decline to process a booking for any reason whatsoever. If a booking cannot be fulfilled for any reason, TalentApp Limited will promptly refund all monies. The making of a booking constitutes your acceptance of TalentApp Limited’s Terms & Conditions of trading. For the protection of our customers, TalentApp Limited reserves the right to undertake additional security checks and if necessary, delay the booking.

2. VAT

Prices quoted include VAT at rates applicable on the day of purchase.

3. Booking Form

TalentApp Limited provides an online booking form for all bookings, which must be completed in order to book a place on a project. A booking is not complete until a form has been submitted and payment taken.

4. Instalments

For larger projects, we offer instalment plans, spread over 3 easy payments, so that our bookings can be easier to pay off over a certain amount of time. If you chose the instalment plan, the cost of the booking may increase with time. The extra cost is an administration charge for arranging and processing instalment plans.

First Payment: The first payment is a non-refundable deposit to hold your booking, due immediately. Should you cancel for any reason, the initial deposit will be retained.

Once you have requested the instalment option during booking through our website, we will send you an email invoice for you to pay the first instalment immediately. You have 48 hours to make your first payment. If we do not receive payment in this time, your reservation will be cancelled and you will have to re-book again.

Second and final payments: Once you have paid the initial deposit, we will send you an email with dates of when the next instalments are due to be made. On each of those dates, we will send you new invoice via email, which you will need to pay within 48 hours.

General

If you would like the instalment option within 28 days before the start of the course, we will only be able to offer you a 2 step instalment plan. The first is the non-refundable deposit and the last instalment will need to be the final balance. The final balance is due no less than 10 working days prior to the project start date.

Late payments

We provide 3 working days grace for late instalment payments. During this time we shall send several reminders via email. Should we not receive communication from you in this time, we will call you. Should we not receive payment, we reserve the right to cancel your booking and retain all monies paid.

This is obviously not what we want to do! So please ensure you make prompt payment. If you are away or have any problems meeting your agreed payment date, please contact us as soon as possible to avoid these cancellation charges.

Should we have to chase you for instalment payments on a regular basis, TalentApp Limited reserve the right to refuse the instalment plan on future bookings and will require the full balance up front.

5. Cancellations – Full payment

Applicable to all TalentApp bookings:

If you have paid the full amount and you wish to cancel your booking any time up to 10 working days prior to the project start date, you have the option to roll your payment over to the next available project or apply for a refund minus a £20 administration fee.

You may only roll your project fee once. Should you wish to roll your payment over to the next course, should there be an increase in the price of the course within the time period of purchase and attending, you will be required to pay the increase 10 working days before the start of the project. 

Should you cancel within the 10 working day run up to the project start date you will be subject to a 100% cancellation fee. On certain occasions we may be able to replace your booking. If this is possible, we may offer you a refund minus £20 administrative fee, however, this is not a guarantee. 

Should you need to cancel due to injury/illness within 10 working days of the project start date, you may be subject to a 100% cancellation charge.  If you cancel outside the 10 working day period due to injury/illness or you are unable to complete part of a project due to an injury or illness, a copy of a valid, dated doctor’s certificate is required (to be provided within 14 working days from the first day of the project) in order to gain a refund minus a £20 admin fee. If you have paid for the course in instalments, your first instalment is non-refundable.

Should we not receive the certificate within the stated period, we reserve the right to retain all monies paid. 

TalentApp Limited cannot be held liable for any travel/accommodation expenses incurred in this instance. A refund can only be made to the purchaser and if payment was originally made by credit/debit card the refund will be made to the same card.

6. Cancellation – Instalment payments

Should you wish to cancel your booking at any time before the 10 working day period to the start of the project and you have paid by our instalment plan, the first payment is non-refundable for all circumstances. We will refund any further instalment payments to you as soon as possible. Please allow 7 working days for your refunds to be processed.

Should you cancel within the 10 working day period to the start of the project, you will be subject to 100% cancellation charge of the full amount. Under certain circumstances, depending on the reason for cancellation, the cancelation charge may be lowered to £50.00. This is at TalentApp’s discretion. 

7. Cancellations: Consumers’ Statutory Right to Cancel

Accrual of the Statutory Right to Cancel the Contract

Should you book Talent or Crew for a purpose that is wholly or mainly outside of your trade, business, craft or profession, you are entitled to a 14-day “cooling off” period beginning the day after the day on which you enter into the contract for the supply of the project with TalentApp Limited.

During the 14-day “cooling off” period you have the right to cancel the contract without giving any reason, and at no cost.

Exercise of the Statutory Right to Cancel the Contract

In order to exercise your right to cancel the contract, you must inform TalentApp Limited of your decision to do so. Should you exercise this right to cancel, TalentApp Limited will refund any and all payments that you have made to it pursuant to the cancelled booking by the end of 14 days after the day on which it is informed of your decision to exercise your right to cancel the contract.

Booking Talent/Crew to Start Within the Statutory “Cooling Off” Period

Should you book a project due to begin during your 14-day “cooling off” period, that period shall expire either at the end of the 14-day “cooling off” period or at the end of the project, whichever occurs first.

Should you exercise your right to cancel the contract during the project, you will be liable to a full cancellation charge (100% of the booking cost). This sum will be set off against any payments that you have already made to TalentApp Limited pursuant to the cancelled contract.

Interaction of the Statutory Right to Cancel for Consumers with TalentApp’s Cancellation Policy

Should you be entitled to a 14-day “cooling off” period, during that 14-day “cooling off” period the provisions within Part 4 of these Terms and Conditions of trading, entitled “Cancellations”, do not apply. The provisions contained within Part 4 of these Terms and Conditions of trading apply as normal after the expiry of the “cooling off” period.

8. Rolling payments over for Bookings

Should you cancel a booking outside of the 10 working day cancellation period, TalentApp Limited will offer you the chance to roll your booking over to a next available Phase and keep hold of your original payment. 

TalentApp Limited will only offer the chance to roll over a booking once.

9. Refunds

Should you cancel a booking within the agreed cancellation time and do not wish to roll your booking over, TalentApp Limited will refund the course fee minus a £20 administration fee.

A refund can only be made to the purchaser and if payment was originally made by credit/debit card the refund will be made to the same card. If payment was made by BACS the refund will be paid back in the same manor to the purchasers account details.

10. DBS Certificate

As a condition of bookings, we require a valid ‘Basic’ DBS Certificate for added security as industry standards.

You must apply for this check yourself and can view more information on how to do this this here

You must email a scanned copy of your DBS Certificate to our office on bookings@talentpp.uk before the project date. The latest we will accept DBS Certificates is 2 working days prior to the start of the project.

DBS Certificates received after this time or on the day of the course will not be accepted as we have to process them on our system before the course date. 

Should any convictions, past or present show up on your DBS Certificate, TalentApp Limited reserves the right to bookings. In this instance,  should payment have been made, a refund will be processed under the terms of our refund policy. 

11. Group bookings

Should you wish to pay for a range of Talent up front, you have 3 months from date of purchase to confirm bookings, before you may be liable to pay any booking price increases that should occur during this period. 

12. No Show

Any member who does not show up for the project or cancels on the morning of the date will be subject to a 100% cancellation fee of the cost of the project. TalentApp Limited accepts a degree of extenuating circumstances, in these instances it is at TalentApp Limited’s discretion to provide a refund or roll the booking over to a future project date.

13. Non-completion of a project

Should you not complete a project, in it’s entirety for reasons not limited to injury/illness/expectation/personal dislike of the booking/project you will not be entitled to a refund of the full amount or any partial amount. 

14. Booking Physicality & Restrictions

All TalentApp bookings may involve medium to high levels of physicality and are therefore subject to restrictions. These include (but are not limited to) age (minimum 18 years) and physical and medical restrictions.

We advise that you clear any insurance needs with appropriate Unions / Productions.

15. Injuries/illness

It is important to be in good physical shape with no injuries or illnesses which may hinder your booking. If the Assistant Directors become aware of any injuries or illnesses not previously disclosed on the booking form and are noticeably affecting their performance, they will be at liberty to assess your physical condition and decide whether you should continue with all/part of the booking.

16. Data Protection

TalentApp Limited maintains strict security measures in order to protect any personal information. This includes following certain procedures, for example encrypting data on our websites, in order to ensure compliance with all applicable legal requirements.

We do not sell or disclose your personal information to other companies without your prior consent. We do not sell mailing lists to third parties. TalentApp Limited is fully PCI Compliant.

17. Training Course Descriptions, Formats and Durations

Details of Training Course descriptions, formats and timings given on our site and in any other literature are intended only to present a general idea of the Training Course, and shall not be considered binding. In particular, photographs are for illustrative purposes only and do not form part of any contract between you and TalentApp Limited.

As TalentApp Limited offers a number of Training Courses, details such as session lengths, itineraries, equipment used and numbers of participants may vary.

18. Discount Codes & Entitlements

TalentApp Limited reserves the right to exclude any booking from discount schemes. Only one discount code may be used per order. Discounts apply to new orders only and cannot be used against exchanges, extensions, money on account, delivery and fulfilment charges or any other facility provided by TalentApp Limited. You may be required to provide evidence of your entitlement to any discount.

19. Third Parties and Re-sale

A person who is not recorded as the project booker with TalentApp Limited has no right under the Contracts (Rights of third Parties) Act 1999 to enforce any terms and conditions of booking.

A Training Course which has been resold by any method (for example, through internet auction sites) without our prior consent will be invalid and TalentApp Limited will not be under any obligation to provide a service.

20. Project Bookings

TalentApp Limited reserves the right to alter or change the course of a booking without prior notification and without refund of monies or exchange of the project.

21. Copyright

All course content is fully copyrighted to TalentApp Limited. All course names and branding is trademarked to TalentApp Limited. On undertaking a booking with TalentApp you agree not to copy/replicate any part of the course including but not limited to; showreel content from profiles, project design/structure, demonstration videos, branding etc. for commercial purposes.

TalentApp Limited takes the protection of its content and branding extremely seriously and should a breach of copyright be noticed, TalentApp Limited reserves the right to seek legal action against the individual / company.

If the individual is a current member / client, TalentApp Limited reserves the right to remove them from any booking with immediate effect.

22. Prices and Locations

All locations and prices are correct at the time of going to press but may change or be withdrawn for reasons beyond our control. Any change of location for reasons beyond TalentApp Limited’s control will be communicated to the participants as soon as possible and will not be subject to any refund, unless the event cannot go ahead and in most occasions, a roll over option will be given.

23. Force Majeure

By booking with TalentApp Limited you acknowledge that filming projects are dependent on certain factors beyond the control of TalentApp Limited and agree that we are not liable for the cancellation, postponement or alteration of any project for reasons beyond our reasonable control (including but not limited to) weather- related reasons, unauthorised access, theft, severe weather, earthquakes or natural disasters, strikes, or other labour problems, wars or governmental restrictions, terrorist actions, mechanical failure, location changes or otherwise.

If these situations should occur, all reasonable efforts will be made to re-schedule the project at the convenience of everyone involved. Please note that bookings and other products/services are subject to change without notice. This does not affect your statutory rights.

24. Cancellation by Client

If a booking or project is cancelled by TalentApp Limited either before or on the day of the event, due to circumstances beyond all reasonable control, TalentApp Limited will arrange to re-book the participant at a mutually agreed time and date at no extra cost.

TalentApp Limited cannot be held liable for any costs including (but not limited to) travel/accommodation expenses incurred in this instance.

25. Liability

Any TalentApp bookings that involve high-risk activities will require the signing of a Liability & Waiver Agreement on client contract agreement..

26. Admittance Rules

If TalentApp Limited’s team deem any participant unsuitable for the project for reasons including, but not limited to, physical injury not mentioned prior to booking, being under the influence of alcohol/drugs and repeated disregard to safety instructions, TalentApp Limited reserves the right to refuse admittance or to remove the participant from the database.

Refunds in this instance are discretionary and TalentApp cannot be held liable for any costs including (but not limited to) travel/accommodation expenses incurred in this instance.

We advise signing up to a Union for additional guidance and support.

27. Availability

Bookings are subject to availability and, in some cases, may be subject to weather conditions. To avoid disappointment we recommend that clients plan well in advance. During peak periods it may be necessary to allow a longer notice period although we might be able to occasionally fit in a booking at short notice.

We strongly advise that you do not make any travel, accommodation or other arrangements until you have received confirmation of your booking and project date.

The details listed above are the terms and conditions applied to TalentApp Limited. Your statutory rights are not affected.
